Rules for buying and selling goods in the online store "www.Elektromodus.lt":
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules"), which are approved by the Buyer (by familiarizing themselves with the Rules and ticking the box next to the statement "I agree with the terms"), become parties and this is a binding legal document that determines the rights and obligations of the Buyer and the Seller, conditions of purchase and payment for goods, order of delivery and return of goods, responsibility of the parties and others related to the purchase and sale of goods on the "www.Elektromodus.lt" website store related provisions.
1.2. The seller reserves the right to change, amend or add to the Rules at any time, taking into account the requirements established by legal acts. The Buyer will be informed about any changes, corrections or additions using the "www.Elektromodus.lt" page, and in order to shop in this online store, he must reconfirm the modified Rules.
1.3. You have the right to buy in this online store:
1.3.1. Natural persons, i.e. persons who have reached the age of majority, whose capacity is not limited by court order;
1.3.2. Minors from fourteen to eighteen years of age, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;
1.3.3. Legal entities;
1.3.4. Authorized representatives of all the above persons.
1.4. By agreeing to the rules, the buyer confirms that, based on Rule 1.4. point, he has the right to buy goods in the "www.Elektromodus.lt" online store.
2. Protection of personal data
2.1. The Buyer can order goods in the online store "www.Elektromodus.lt" in two ways:
2.1.1. by registering on this website by entering your username and password;
2.1.2. without registering on this website.
2.2. When ordering goods, the buyer both 2.1.1. both 2.1.2. In the manner provided in the clauses of the rules, in the relevant information fields provided by the Seller, the personal data necessary for the proper fulfillment of the goods order must be indicated: name, surname, delivery address of the goods, telephone number and e-mail address.
2.3. By approving these Rules, the buyer agrees that 2.2. his personal data referred to in point would be processed for the purposes of direct marketing in the electronic store for the sale of goods and services "www.Elektromodus.lt".
2.4. The Buyer, by agreeing to the processing of his personal data for the purpose of selling goods and services in the electronic store belonging to the Seller, also agrees to the sending of informational messages to the e-mail address specified by him, which are necessary to fulfill the order for goods.
2.5. The buyer, who does not want the e-mail e-mail address is processed for the purpose of direct marketing, must inform the Seller about this, from Rules 2.2. by sending a message to the administrator of "www.Elektromodus.lt" to the e-mail address specified in the procedure provided for in point;
2.6. The seller confirms that the personal data specified by the Buyer will be processed only in the online store for the sale of goods and services "www.Elektromodus.lt", direct marketing (except for cases where the Buyer informs in accordance with the procedure specified in Clause 2.5 of the Rules that he does not want his personal data to be processed directly for marketing purposes) purposes. The Seller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Seller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.
2.7. The Buyer's identity document and the Buyer's data contained in it provided to the Seller or Delivery Service employee are used only for proper identification of the individual.
3. The moment of conclusion of the purchase-sale contract
3.1. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart, clicks on the "Pay" link.
3.2. Each purchase-sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the "www.Elektromodus.lt" online store.
4. Buyer's rights
4.1. The buyer has the right to buy goods in the "www.Elektromodus.lt" online store in accordance with the procedure set forth in these Rules and other information sections of the Seller's online store.
4.2. The buyer has the right to refuse the contract of purchase and sale of goods concluded with the "www.Elektromodus.lt" online store by notifying the Seller by e-mail within 14 working days, indicating the desired return of the product and its order number.
4.3. 4.2 of the rules. The Buyer's right provided for in paragraph 1 is implemented in accordance with the 2001 Decree of the Minister of Economy. August 17 by order no. 258 of the approved "Rules for the sale of goods and provision of services when contracts are concluded using means of communication".
4.4. The Buyer can exercise the right provided for in Clause 4.2 of the Rules only if the product has not been damaged, its appearance has not changed, nor has it been used and the Buyer has the original packaging of the product.
5. Obligations of the buyer
5.1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
5.2. After registering, the Buyer undertakes not to transfer his login data to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this via the means of communication specified in the "Contact" section.
5.3. If the data provided in the registration form of the registered Buyer changes, he must update them immediately.
5.4. The buyer, using the "www.Elektromodus.lt" online store, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.
6. Seller's Rights
6.1. The seller has the right to determine the minimum size of the shopping cart at his discretion, i.e. the minimum amount, upon reaching which the Buyer's order will be executed. The size of this amount is visible when viewing the shopping cart.
6.2. If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend the access to the online store, or in exceptional cases cancel the Buyer's registration.
6.3. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
6.4. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer, having chosen the provided payment methods, does not pay for the goods within 5 working days.
7. Obligations of the seller
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store "www.Elektromodus.lt" under the conditions set out in these Rules and the online store.
7.2. The Seller undertakes to respect the Buyer's privacy right to his personal information, i.e. The personal data specified by the buyer shall be processed only in accordance with Chapter 2 of the Rules and the procedure established by the legal acts of the Republic of Lithuania.
7.3. The seller undertakes to deliver the goods ordered by the buyer in the way chosen by the buyer, i.e. pick up on the spot or deliver to the specified address.
7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous product or the product most similar in its characteristics, the Seller undertakes to return the money paid to the Buyer within 7 working days, if prepayment was made.
7.5. After the buyer uses Rule 4.2. the right provided for in point 4.4 of the Rules. clause, the Seller undertakes to return the money paid to the Buyer within 7 working days, counted from the day of receipt of the returned goods.
8. Product prices, payment procedure and terms
8.1. The prices of goods in the online store and in the formed order are indicated in euros with VAT.
8.2. The buyer pays for the goods in one of the following ways:
8.2.1. Payment using the Stripe electronic payment system. The responsibility for data security in this case falls on the "Stripe" system, since all monetary transactions take place in the bank's electronic banking system.
8.2.2. Payment by bank transfer is an advance payment, when the Buyer, after forming the order, transfers the money to the bank account of "www.Elektromodus.lt".
8.3. In accordance with 8.2.1., 8.2.2. the payment methods provided in clauses, the Buyer undertakes to pay immediately. In the aforementioned cases, taking into account Rule 6.4. the Seller's right provided for in point 1, only upon receipt of payment for the goods, the goods parcel begins to be formed and the deadline for the delivery of the goods begins to be calculated.
9. Delivery of goods
9.1. When ordering goods, the buyer can choose the method of delivery of the goods, i.e. use the delivery service provided by the Seller via Lithuanian Post or at the Seller's pick-up point and can pick up the goods himself from the storage areas used by the company.
9.2. Delivery of goods to the Buyer:
9.2.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
9.2.2. When picking up the goods, the buyer must evaluate the product's packaging (if packed), unpack the product (if packed) and refuse to accept the product if the product's packaging is severely damaged (dented, punctured or torn) or the product itself has externally visible damages. The buyer has no right to make claims against the seller for goods damaged during transportation. All claims must be submitted in writing to the courier at the time of collection. The Seller does not compensate for the damage if the Buyer accepted the shipment without comments. From the moment of acceptance of the shipment, the entire risk of accidental loss or damage of the items (goods) in the shipment passes to the Buyer.
9.2.3. The buyer undertakes to accept the goods at the address specified by himself or by picking up the goods at a Lithuanian post office. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
9.2.4. The goods are delivered by the Seller by sending the goods via courier to the specified address at home or to the specified post office.
9.3. Collection of goods at the Seller's collection points:
9.3.1. The buyer can pick up the goods free of charge on working days from 8:00 a.m. until 5 p.m. from the Seller's pick-up point, located at Đžuolų 6-oji g. 4, Kalikstiškiu vs., LT-14249 Vilnius. When collecting the goods, the buyer must evaluate the product packaging according to the procedure specified in point 9.2.2. The Seller does not compensate for the damage if the Buyer accepted the goods without comments. From the moment of acceptance of the goods (shipment), all the risk of accidental loss or damage of the items (goods) in the shipment passes to the Buyer. The buyer does not have the right to make claims against the seller for goods damaged during transportation by him or by the courier he hires.
9.4. The Seller provides the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such a case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.
9.5. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.
9.6. More detailed information regarding the delivery of goods is provided in the "Delivery Terms" section.
10. Product quality guarantee and expiration date
10.1. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
10.2. The Seller is not responsible for any product defects if the Buyer has not properly fulfilled or failed to fulfill Rule 9.2. Mr.
10.3 For contract works, the Seller provides the guarantees provided by the laws of the Republic of Lithuania arising from the legal relationship of the contract.
10.4 The seller confirms that the quality of the goods meets the requirements of the laws and other legal regulations of the Republic of Lithuania and the technical parameters of the equipment. For equipment/goods that are used through electronic commerce or in the performance of a contract, the Seller provides the guarantees provided for in the laws of the Republic of Lithuania arising from the legal relationship of purchase and sale. The Seller does not assume any voluntary guarantee obligations for other persons.
10.5 The Buyer must immediately notify the Seller in writing of defects (deficiencies) in works/equipment observed during the warranty period.
10.6 The Seller assesses, reacts to, and repairs observed defects based on the terms of the warranty service agreement, and in the absence of such an agreement, the Seller assesses and repairs warranty defects due to contract work at his own expense at the place of occurrence of the defect, and assesses and repairs defects due to equipment at his own expense at the Seller's office.
10.7 The Buyer must deliver the defective equipment and pick up the repaired or replaced equipment under the warranty conditions at the address Ėuolų 6-oji g. 4, Kalikstiškiu vs., LT-14249 Vilnius on working days, during working hours.
11. Return and exchange of goods
11.1. Defects of the sold goods are removed, low-quality goods are replaced, returned under the guidance of the Minister of Economy in 2001. June 29 by order no. 217 "Regarding the approval of the rules for the return and exchange of items" approved rules for the return and exchange of items.
11.2. To return the product(s) 11.1. In the cases specified in the clause of the rules, the Buyer must fill out the goods return document and send it by e-mail and present the returned goods.
11.3. 11.1. The Buyer can exercise the right provided for in the clause of the Rules within 14 working days from the day of delivery of the goods to him, informing the Seller about it 4.2. The procedure provided for in the clause of the rules.
11.4. When returning goods to the buyer, it is necessary to comply with the following conditions:
11.4.1. the returned product must be in its original, neat packaging (this clause does not apply in the case of a defective product being returned);
11.4.2. the product must be undamaged by the Buyer;
11.4.3. the item must be unused, without losing its merchandise appearance (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective item);
11.4.4. the returned product must have the same composition of components and accessories as the one received by the Buyer;
11.4.5. when returning the product, it is necessary to present the purchase document, the warranty card (if it was issued) and the completed 11.2. The return document specified in the clause of the rules.
11.4.6. If the buyer refuses quality goods, an order administration fee of EUR 50 + VAT is applied. The order administration fee is intended to cover the costs of electronic trading systems, bank fees, the costs of order processing and inspection of returned goods. When the Buyer is refunded for quality goods, the Order Administration Fee is deducted from the paid amount and the Seller undertakes to return to the Buyer only the balance of the paid amount.
11.5. The Seller has the right not to accept the goods returned by the Buyer, if the Buyer does not follow the procedure for returning the goods established in this article.
11.6. The Buyer can deliver the returned goods himself to the address Azuolų 6-oji g. 4, Kalikstiškiu vs., LT-14249, on weekdays from 9 a.m. until 6 p.m., or send using the services of Lithuanian Post or another shipping service provider. When the returned product is of good quality and meets the specified measurements, but it is returned for the sake of the Buyer, the shipping costs of returning the product to the Seller are paid by the Buyer. Otherwise, the Seller pays. When the received wrong product and/or low-quality product is returned, the Seller undertakes to take such products and replace them with similar suitable products. In the event that the Seller does not have similar goods, he returns the money paid for the goods(s) to the Buyer within 7 working days.
11.7. The return and exchange of goods is carried out in accordance with the 2001 regulation of the Minister of Economy. June 29 by order no. 217 approved "Rules for return and exchange of items" and the Minister of Economy in 2001 August 17 by order no. 258 of the approved "Rules for the sale of goods and provision of services when contracts are concluded using means of communication".
11.8. In all cases, money for returned goods is transferred by payment order and only to the payer's bank account.
12. Exchange of information
12.1. The seller sends all messages according to 2.2 of the Rules. the procedure provided for in paragraph 1. to the e-mail address provided by the Buyer.
12.2. The Buyer sends all messages and questions using the means of communication specified in the "Contact" section of the Seller's online store.
13. Final Provisions
13.1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
13.2. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
13.3. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
